Amendments to Turkish data protection law
On 2 March 2024, long-awaited amendments to Turkish Data Protection Law were accepted by the Turkish parliament as part of an omnibus bill. The amendments will now await presidential approval, which is expected in the coming days, before entering into force. The amendments to the Turkish Data Protection Law (Law No. 6698) (the “TDPL” – see our previous client briefing on the introduction of the TDPL), principally concern restrictions on the processing of so-called “special categories” of personal data and on transfers of personal data abroad (the “Amendments”). They have been accepted by the Grand National Assembly of Türkiye on 2 March 2024, and are planned to enter into force on 1 June 2024 (or 1 September 2024 for international data transfers, allowing a transitionary period of three months).

Meta faces Turkish competition authority injunction and fines over data sharing practices
On 18 March 2024, the Turkish Competition Authority ("TCA") has issued an interim injunction against Meta Platforms, Inc. halting the sharing of data between Instagram and Threads. Additionally, Meta faces an administrative fine of around TRY 4.8 million due to its inadequate response to alleviate anti-competitive concerns.

Streamlining corporate governance: updates to the Turkish commercial code
On 29 May 2024, several important changes to the Turkish Commercial Code ("TCC") have come into effect as part of an omnibus bill. These changes are poised to streamline corporate governance and compliance processes for businesses operating in Türkiye and include amendments to the election of the chairperson of the board of directors, share capital requirements, and appointment of representatives, all of which are designed to enhance operational efficiency and reduce bureaucratic red tape.

Recent developments in ai legislation in the EU and Türkiye
On 12 July 2024, after years of consultation, drafting and negotiation, the EU Artificial Intelligence Act (Regulation EU (2024/1689)) (the "EU AI Act") was officially published in the EU's Official Journal. This landmark is the first of its kind, setting a precedent for future AI related laws in many countries, including Türkiye.
